OVERVIEW
Welcome to MAWKO Supply Co., the vintage-goods arm of MAWKO Co. The terms “we,” “us” and “our” refer to MAWKO Co., operating as MAWKO Supply Co.
MAWKO Supply Co. operates this website and online store. Shopify provides the ecommerce platform that allows us to offer our products and services.
By visiting our website, creating an account or placing an order, you agree to these Terms of Service. Our Privacy Policy explains how we handle personal information. Our Purchase Terms & Shipping page, Return and Refund Policy and Shipping Policy also apply to your order, subject to applicable law.
If you do not agree to these terms, please do not use the website or place an order.
ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your state or jurisdiction to place an order.
You agree to provide accurate and current account, billing, payment and shipping information.
You are responsible for protecting your account credentials and for activity conducted through your account.
OUR PRODUCTS
MAWKO Supply Co. offers individually sourced vintage and pre-owned watches, art, objects, accessories, apparel, books and marine goods.
Each piece has its own history, condition and character. Vintage pieces may show patina, wear, repairs, restoration, replacement components or other evidence of age and prior use.
The photographs, description, condition notes, included items, provenance information and product-specific disclosures collectively form the description of each piece.
We make every reasonable effort to photograph and describe products accurately. Color and appearance may vary slightly depending on your screen or device.
Please review all available product information carefully and ask us any questions before purchasing.
ORDERS
Submitting an order is an offer to purchase. An order is accepted when we confirm it and successfully process payment.
Before acceptance, we may decline an order because of product availability, pricing or listing errors, suspected fraud, payment issues, shipping restrictions or legal requirements. After acceptance, we may cancel an order only where permitted by applicable law.
If we cancel an entirely unshipped order, we will refund the full amount paid, including any shipping charges, to the original payment method. For a partial cancellation, we will refund the cancelled items and any applicable shipping charges.
All sales are final except for defective or non-conforming goods, where otherwise stated in our purchase and return policies, or where required by applicable law.
We do not accept returns, exchanges or cancellations for changes of mind, personal preferences, fit, disclosed wear or characteristics inherent to vintage goods.
Purchases made through a third-party marketplace are also subject to that marketplace’s terms and buyer-protection policies.
PRICING AND PAYMENT
Prices may change without notice before an order is accepted.
Prices on MAWKOSupply.com may differ from prices offered through private transactions or third-party marketplaces because transaction fees, services and selling costs vary by channel.
Unless otherwise stated, prices do not include applicable sales tax, customs duties, import charges or separately quoted shipping costs.
You confirm that you are authorized to use the payment method submitted and agree to pay all charges associated with your order.
SHIPPING AND DELIVERY
Processing periods, shipping arrangements and applicable charges are described in our Purchase Terms & Shipping page, Shipping Policy and individual product listings.
If we cannot ship within the stated processing period, we’ll contact you to request agreement to revised timing or arrange cancellation and a prompt refund. If we do not obtain any consent required by law, we’ll cancel and promptly refund the unshipped portion of your order.
Delivery dates and transit times are estimates. Carrier delays, customs processing, weather, island transportation, inaccurate delivery information and other circumstances outside our reasonable control may affect delivery. This does not limit any rights or remedies provided by applicable law.
Please provide a complete and accurate delivery address and inspect your package promptly after delivery.
If an item arrives damaged or materially different from its description, contact hi@mawko.com with your order number and clear photographs of the item, packaging and shipping label. Please retain the packaging while we review the matter.
For a shipment that appears lost or is marked delivered but has not arrived, contact us with your order number so we can investigate.
Certain products and materials, including exotic leathers, may be subject to destination-specific shipping, import or export restrictions.
SHOPIFY AND THIRD-PARTY SERVICES
Shopify powers our online store, but all purchases are made directly between you and MAWKO Supply Co.
Shopify is not the seller of the products offered through our store.
Our website may include links, tools or services provided by third parties. Your use of those services is subject to the applicable third party’s terms and policies.
INTELLECTUAL PROPERTY
The original photographs, descriptions, editorial content, graphics, branding and website materials created by MAWKO Supply Co. are owned by or licensed to MAWKO Supply Co.
You may not reproduce, distribute, modify, publish or commercially use our content without prior written permission, except as permitted by applicable law.
Third-party brand names, trademarks and logos remain the property of their respective owners. They are used only to identify and describe products accurately.
MAWKO Supply Co. is an independent curator and reseller and is not affiliated with, sponsored by or endorsed by any third-party brand unless expressly stated.
If you submit a review, photograph or other content, you confirm that you have the right to do so and give us permission to use it in connection with our business, subject to applicable law and our Privacy Policy.
ACCEPTABLE USE
You may use the website only for lawful purposes.
You may not:
- Commit fraud or provide false information
- Violate any law or another person’s rights
- Infringe intellectual property rights
- Upload viruses or harmful code
- Interfere with website security or operation
- Scrape, copy or commercially exploit website content without permission where such permission is legally required
- Use automated systems to bypass security or access restrictions
- Harass, threaten or harm another person
We may restrict or terminate access if these terms are violated.
PRIVACY
Personal information collected through the website is handled in accordance with our Privacy Policy.
Shopify and other service providers may process information as necessary to operate the store, process payments, prevent fraud and fulfill orders.
WEBSITE INFORMATION AND WARRANTIES
We make reasonable efforts to keep website information accurate and current, but occasional errors or omissions may occur.
We may correct product information, pricing, availability or other errors before an order is accepted.
The website and online services are provided on an available basis. We do not guarantee uninterrupted or error-free access.
Products purchased from us are subject to the description provided in the applicable product listing and to any rights, warranties or remedies that cannot legally be excluded, modified or waived.
Nothing in these terms limits any consumer right that cannot legally be waived.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, MAWKO Supply Co. will not be liable for indirect, incidental, special, punitive or consequential damages arising from use of the website or services.
To the extent permitted by law, we are not responsible for delays, interruptions or losses caused by events outside our reasonable control. This does not affect our obligations concerning orders, refunds or other mandatory consumer remedies.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.
You are responsible for losses or claims caused by your unlawful use of the website or material violation of these terms, to the extent permitted by law.
ERRORS AND AVAILABILITY
We may correct errors and update product information, pricing or availability. Corrections made after an order has been accepted do not automatically change that order. Any cancellation and refund will be handled under the Orders section and applicable law.
Products may be discontinued or removed from the website at any time.
GENERAL TERMS
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
These terms, together with the policies referenced in them, form the complete agreement concerning use of the website and online store, without excluding any representations or rights that applicable law requires us to honor.
You may not transfer your rights or obligations under these terms without our written consent, except where applicable law permits otherwise.
We may update these terms by publishing a revised version on the website and updating the date shown at the top of the page. Revised terms apply to future orders and do not retroactively change the terms of an order already accepted. We will provide any notice required by applicable law.
GOVERNING LAW
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
Mandatory consumer protection laws in another jurisdiction will continue to apply where legally required.
Any legal proceeding relating to these terms will be brought in a state or federal court located in Massachusetts, unless applicable law requires otherwise.
